Terms of Use

1. Provider and payment seller

Marathoner is provided by Nikita Somov, trading as UpgradeYour.AI, Dubai, United Arab Emirates ("we", "us"). Creem acts as Merchant of Record for purchases: Creem processes the payment, appears as the seller for payment and tax purposes, and provides receipts and applicable tax handling. These terms govern your license and use of Marathoner; Creem's checkout terms also apply to the transaction.

2. The product

Marathoner is a native macOS menu-bar utility for monitoring Claude Code usage limits and helping long-running Claude Code sessions pause and resume around usage resets. It requires a compatible Mac, a working Claude Code installation or supported Claude desktop environment, and a valid account with the relevant third-party provider. System requirements and features may change as those third-party products evolve.

3. Trial, price, and license

Marathoner includes a 3-day free trial. The advertised one-time purchase price is shown before checkout and may vary by currency, region, promotion, or applicable taxes. Unless the checkout states otherwise, one paid license permits activation on up to three Macs used by the purchaser. The license is personal, limited, non-exclusive, non-transferable, and revocable if these terms are materially breached.

You may not resell, sublicense, share or publish a license key; circumvent licensing or usage controls; reverse engineer the software except where applicable law expressly permits it; use it unlawfully; or distribute a modified or unmodified copy without written permission.

4. Delivery and updates

Digital delivery instructions, a download, and/or license information are provided after successful payment. You are responsible for using a valid email address and maintaining compatible hardware and software. A one-time license covers the purchased version and maintenance updates we choose to release; it does not promise every future major version or a perpetual update service.

5. Refunds

You may request a refund within 14 calendar days after purchase by emailing support@upgradeyour.ai from the purchase email and including the order ID. Approved refunds are returned to the original payment method. Additional details appear in our Refund Policy. Nothing in these terms limits mandatory consumer rights that apply in your country.

6. Third-party services and independence

Claude, Claude Code, Anthropic, OpenAI, macOS, and other names are trademarks of their respective owners. Marathoner and UpgradeYour.AI are independent products and are not affiliated with, endorsed by, or sponsored by Anthropic or OpenAI. Your use of third-party products remains subject to their terms. We do not control their availability, limits, APIs, commands, or policy changes.

7. Acceptable use

You must use Marathoner only with accounts, systems, and workflows you are authorized to access, and in compliance with applicable law and third-party terms. You must not use the software to interfere with services, evade provider restrictions, introduce malware, or violate the rights of others.

8. Availability and changes

We aim to keep Marathoner useful and reliable but do not guarantee uninterrupted or error-free operation. Features may stop working because of macOS or third-party changes. We may patch, modify, discontinue, or replace features for security, compatibility, legal, or product reasons.

9. Disclaimers

To the maximum extent permitted by law, Marathoner and the website are provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Marathoner is an operational aid, not a guarantee that a task will complete, that a Mac will remain awake in every condition, or that third-party usage information will always be accurate. Closing a laptop lid or system settings may override sleep-prevention behavior.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for loss of data, interrupted work, missed tasks, third-party account action, or service unavailability. Our aggregate liability arising from Marathoner will not exceed the amount you paid for the product during the 12 months before the claim. These limitations do not apply where prohibited by law.

11. Termination

You may stop using Marathoner at any time. We may suspend or terminate a license for material breach, fraud, payment reversal, unlawful use, or threats to the product or others. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

12. Governing law

These terms are governed by the laws applicable in the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-law rules. Courts located in Dubai have jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.

13. Changes and contact

We may update these terms prospectively. The effective date identifies the latest version. If a material change affects an existing paid license, we will provide reasonable notice where practical. Questions may be sent to the contact below.
