1. Who we are

UpgradeYour.AI is operated by Nikita Somov, an individual based in Dubai, United Arab Emirates ("UpgradeYour.AI", "we", "us"). For applicable data-protection law, Nikita Somov is the controller of personal data described in this policy. Contact: support@upgradeyour.ai.

2. Scope

This policy applies to the UpgradeYour.AI website, the Marathoner macOS application, purchases, licensing, and support communications. Third-party services have their own privacy notices.

3. Information we process

Website and technical data

Our hosting provider may automatically process limited request data such as IP address, browser type, device type, requested URL, timestamps, and security logs to deliver and protect the website. We do not currently use advertising cookies or third-party behavioral analytics.

Purchases and licensing

Payments are processed by Creem as Merchant of Record. Creem collects payment and billing information under its own privacy policy. We may receive order details needed to fulfil and support your purchase, such as your name, email address, country, order identifier, product, payment status, refund status, and license information. We do not receive or store full payment-card details.

Support

If you contact us, we process your email address, message, attachments, and relevant order or diagnostic information you choose to provide.

Marathoner app data

Marathoner reads local Claude Code usage information and local configuration needed to show limits and operate its guard features. This processing occurs on your Mac. Marathoner does not read or store your Claude prompts or conversations and does not collect Claude API keys or authentication tokens. License validation may send a license key and limited device or activation information to our licensing/payment provider.

4. Why we process information

• To provide downloads, licenses, updates, and customer support and to perform our contract with you.
• To process transactions, refunds, accounting records, and legal obligations.
• To secure the website, prevent fraud and abuse, and diagnose reliability issues based on our legitimate interests.
• For any other purpose with your consent where consent is required.

5. Service providers and international transfers

We disclose information only as needed to providers that host the website, process payments, manage licenses, deliver email or downloads, and support security and operations; to professional advisers; or when required by law. These providers may process data in countries other than yours. Where required, transfers are protected through appropriate contractual or legal safeguards.

6. Retention

We retain order and transaction records for as long as needed to provide the license and meet tax, accounting, fraud-prevention, and legal requirements. Support correspondence is generally kept only while useful to resolve the request and maintain an appropriate service history. Hosting and security logs are retained according to the provider's operational schedule.

7. Your rights

Depending on your location, you may have rights to access, correct, delete, restrict or object to processing, receive a portable copy of your data, or withdraw consent. You may also complain to your local data-protection authority. To exercise a right, email us. We may request reasonable verification before acting on a request.

8. Security and children

We use reasonable administrative and technical measures to protect information, but no online system is completely secure. Marathoner and this website are intended for adults and are not directed to children under 13. We do not knowingly collect children's personal data.

9. Changes

We may update this policy as the product or legal requirements change. We will publish the revised policy here and update its effective date. Material changes may also be communicated through the product or by email where appropriate.
